These Terms and Conditions of Sale apply to purchases made through the website operated by Fen Air International Ltd (“we”, “us”, “our” or “Fen Air International”).

By placing an order through our website, you agree to be bound by these Terms and Conditions.

2. Application of These Terms

2.1 These Terms and Conditions apply to all sales of motor vehicle parts and related products made through our website.

2.2 If you are purchasing products as a consumer, nothing in these Terms and Conditions affects your statutory rights under applicable UK consumer protection legislation.

2.3 If you are purchasing products wholly or mainly for business purposes, additional provisions may apply as set out in these Terms.

2.4 We reserve the right to amend these Terms and Conditions from time to time. The Terms in force at the time you place your order will normally apply to that order.

3. Product Information

3.1 We make reasonable efforts to ensure that product descriptions, photographs, specifications, dimensions, compatibility information and other information displayed on our website are accurate.

3.2 Images are provided for illustrative purposes and may not always represent the exact product supplied. Product colours and appearance may vary depending on your device or screen.

3.3 Product specifications may be changed by manufacturers or suppliers without notice. Where a change does not materially affect the functionality of the product, we may supply the updated version.

3.4 It is your responsibility to check that a product is suitable for your vehicle before ordering.

3.5 Where vehicle registration, VIN, chassis number, engine code, part number or other identification information is requested, you should provide accurate and complete information.

3.6 Where we provide a compatibility check, this is based on the information available to us and the information you provide. You should still verify that the part is suitable before installation.

3.7 Unless expressly stated otherwise, a part being described as suitable for a particular vehicle does not guarantee compatibility with every variant, specification, engine, model year or modification of that vehicle.

4. Product Part Numbers and Compatibility

4.1 Manufacturer and OE/OEM part numbers are provided for identification and comparison purposes where applicable.

4.2 References to vehicle manufacturers, trademarks or original equipment manufacturer part numbers do not necessarily mean that the product is manufactured by or approved by the relevant vehicle manufacturer.

4.3 Where a product is described as an equivalent, replacement, aftermarket or compatible part, this does not mean that it is an original manufacturer part unless expressly stated.

4.4 If you are uncertain whether a part is suitable for your vehicle, please contact us before placing your order.

5. Orders

5.1 When you place an order through our website, you are making an offer to purchase the products selected by you.

5.2 After placing an order, you should receive an acknowledgement confirming that we have received your order. This acknowledgement does not necessarily mean that your order has been accepted.

5.3 A contract for the sale of the products will be formed when we confirm acceptance of your order, normally by sending an order confirmation or dispatch confirmation.

5.4 We reserve the right to refuse or cancel an order before acceptance, including where:

  • the product is unavailable;

  • there is an error in the product description or price;

  • we are unable to obtain the product from our supplier;

  • the information supplied by you is incomplete or inaccurate;

  • we suspect fraudulent or unauthorised activity; or

  • there is another legitimate reason why we cannot fulfil the order.

5.5 If we cancel an order after you have paid, we will refund the amount paid for the cancelled products.

6. Prices

6.1 Product prices are displayed on our website at the time you place your order.

6.2 Unless otherwise stated, prices Exclude VAT where VAT is applicable.

6.3 Delivery charges, where applicable, will be displayed before you complete your purchase.

6.4 Although we take reasonable care to ensure prices are accurate, errors can occur. If we discover a pricing error before your order is accepted, we may contact you to confirm whether you wish to proceed at the correct price.

6.5 If you do not wish to proceed with an order affected by a pricing error, you may cancel the order and receive a refund of any payment made.

7. Payment

7.1 Payment must be made using the payment methods made available on our website.

7.2 Payment must normally be received before products are dispatched unless we have expressly agreed otherwise in writing.

7.3 We may use third-party payment providers to process payments. Your use of those services may also be subject to their own terms and conditions.

8. Delivery

8.1 We will deliver products to the delivery address provided when you place your order.

8.2 Estimated delivery times are provided in good faith but are not guaranteed unless we have expressly agreed a guaranteed delivery date.

8.3 Delivery times may be affected by circumstances outside our reasonable control, including courier delays, adverse weather, strikes, customs delays, supply shortages or other events beyond our control.

8.4 If you provide an incorrect or incomplete delivery address, you may be responsible for additional delivery charges incurred as a result.

8.5 You should inspect the packaging and products as soon as reasonably possible after delivery.

8.6 If a parcel appears to be damaged when delivered, you should, where possible, record the damage and contact us promptly.

9. International Delivery

9.1 Where we offer delivery outside the UK, additional delivery charges, customs requirements, import duties, taxes and other charges may apply.

9.2 Unless expressly stated otherwise, the customer is responsible for any import duties, customs charges or local taxes applicable to an international order.

9.3 International customers are responsible for ensuring that products ordered are lawful and suitable for import and use in their destination country.

9.4 Delivery times for international orders may be affected by customs procedures and other factors outside our control.

10. Consumer Cancellation Rights

10.1 If you are a consumer purchasing products online, you may have a statutory right to cancel your order within 14 days after the day on which you, or a person nominated by you, receives the goods, subject to applicable legal exceptions.

10.2 If an order consists of multiple products delivered separately, the cancellation period may run from the day you receive the final product.

10.3 To exercise a statutory cancellation right, you should clearly inform us of your decision to cancel. You may contact us using the details provided in Section 1.

10.4 Where you validly cancel an order under applicable consumer cancellation legislation, we will refund the payments due to you in accordance with applicable law.

10.5 We may withhold reimbursement until we have received the returned goods or you have provided evidence that you have sent them back, whichever occurs first.

10.6 You must take reasonable care of products while they are in your possession. Where legally permitted, you may be responsible for any reduction in the value of goods resulting from handling beyond what is reasonably necessary to establish their nature, characteristics and functioning.

11. Exceptions to Cancellation Rights

Certain products may be excluded from statutory cancellation rights where an applicable legal exception applies.

This may include products which:

  • have been made to your specifications or clearly personalised;

  • are sealed goods that are not suitable for return for health protection or hygiene reasons once unsealed, where applicable; or

  • fall within another statutory exception.

Where a product is not eligible for cancellation, this will not affect your statutory rights relating to faulty, defective or misdescribed goods.

12. Returns

12.1 If you wish to return a product you have 14 days in which to do so, please notify us within 24 hours of delivery of the products, you must accept its your responsibility to check the condition of your goods upon delivery for and damage caused in transit and inform us immediately stating your reason or issue, please contact us before sending it back where possible so that we can provide the appropriate returns instructions.

12.2 Products should be returned securely packaged and, where reasonably possible, in suitable resalable condition.

12.3 Where a product is returned because you have changed your mind, you will be responsible for the direct cost of returning the product unless we have agreed otherwise or applicable law requires us to pay the return costs.

12.4 Nothing in this section limits your legal rights where a product is faulty, defective, not as described or otherwise does not conform to the contract.

13. Faulty, Damaged or Incorrect Products

13.1 If you receive a product that is faulty, damaged, defective, incorrectly supplied or does not conform to the contract, please contact us as soon as reasonably possible, preferably within 24 hours of receipt of delivery from our couriers partners.

13.2 Depending on the circumstances and applicable law, you may be entitled to a repair, replacement, price reduction or refund.

13.3 Consumer rights relating to faulty or defective goods are not limited by any warranty period stated by us or by a manufacturer.

13.4 Where a product is returned because it is alleged to be faulty, we may need to inspect or test the product to determine the nature of the issue, personal expectations are not deemed as a engineering basis for rejection on serviceability.

13.5 We will not treat normal wear and tear, accidental damage, misuse, improper installation or damage caused by circumstances outside the product's intended use as a manufacturing defect where applicable.

14. Installation of Motor Vehicle Parts

14.1 Unless expressly stated otherwise, products are supplied on the basis that installation will be carried out by a suitably qualified and competent person, you maybe asked to prove your qualifications as a motor vehicle engineer to substantiate your claim.

14.2 We strongly recommend that safety-critical vehicle components are installed by a suitably qualified professional.

14.3 You are responsible for ensuring that the product is installed correctly and in accordance with the relevant manufacturer's instructions.

14.4 We are not responsible for damage caused by incorrect installation, improper fitting, modification, alteration, misuse, neglect or use of a product for a purpose for which it was not designed, except where liability cannot legally be excluded.

14.5 If a part requires coding, programming, calibration, adaptation or specialist equipment after installation, you are responsible for ensuring that this work is carried out where required.

15. Vehicle Safety and Legal Compliance

15.1 It is your responsibility to ensure that any part purchased is suitable and legally permitted for use on your vehicle and in the country where the vehicle is operated.

15.2 Some modifications or replacement parts may affect vehicle safety, emissions, roadworthiness, insurance, type approval, MOT compliance or other legal requirements.

15.3 We do not recommend using any product in a manner that would make a vehicle unsafe or unlawful.

15.4 Where a product is intended for motorsport, off-road use, competition or another restricted purpose, this will be stated in the relevant product information where applicable.

16. Warranties and Manufacturer Guarantees

16.1 Some products may be supplied with a manufacturer's warranty or guarantee.

16.2 Where applicable, details of any manufacturer's warranty will be provided with the product or in the relevant product description.

16.3 A manufacturer's warranty is additional to, and does not replace, your statutory rights.

16.4 Unless expressly stated otherwise, we do not provide an additional warranty beyond the manufacturer's warranty and your statutory rights.

17. Used, Reconditioned and Refurbished Parts

17.1 Where a product is described as used, reconditioned, refurbished, remanufactured or otherwise previously used, its condition will be described in the relevant product listing.

17.2 Used products may show reasonable signs of previous use, including cosmetic marks, wear or differences in appearance.

17.3 Any specific defects, limitations or known issues that materially affect the product will be disclosed where reasonably known to us.

17.4 Used or refurbished products remain subject to applicable statutory consumer rights.

18. Liability

18.1 Nothing in these Terms and Conditions excludes or limits liability where doing so would be unlawful.

18.2 In particular, nothing in these Terms and Conditions excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.

18.3 Subject to Section 18.2, we will not be responsible for losses that are not reasonably foreseeable or for losses that arise indirectly from your purchase or use of a product.

18.4 We are not responsible for damage caused by incorrect installation, modification, misuse or failure to follow applicable instructions, except where such liability cannot legally be excluded.

18.5 Nothing in these Terms affects the statutory rights of consumers.

19. Events Outside Our Control

19.1 We will not be responsible for delay or failure to perform our obligations where the delay or failure results from circumstances beyond our reasonable control.

19.2 Such circumstances may include, without limitation:

  • natural disasters;

  • severe weather;

  • fire;

  • flood;

  • power or telecommunications failures;

  • strikes or industrial disputes;

  • transport or courier disruption;

  • supplier failures;

  • shortages of materials or products;

  • government restrictions;

  • customs delays; or

  • other events beyond our reasonable control.

19.3 We will take reasonable steps to minimise the effect of such events and resume normal performance as soon as reasonably practicable.

20. Website Use

20.1 You must not misuse our website, attempt to gain unauthorised access to our systems, interfere with the operation of the website, or use the website for fraudulent or unlawful purposes.

20.2 We may suspend or restrict access to our website where reasonably necessary for security, maintenance or other legitimate purposes.

20.3 We do not guarantee that the website will always be available or free from errors, although we will take reasonable steps to maintain its operation.

21. Intellectual Property

21.1 All intellectual property rights in our website, including text, graphics, logos, designs, photographs and other content owned by us, belong to Fen Air International Ltd or our licensors.

25.3 If you are a consumer, you may bring legal proceedings in the courts of the part of the UK in which you live where applicable.

26. Severability

If any provision of these Terms and Conditions is found to be unlawful, invalid or unenforceable, that provision will be treated as modified or removed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

27. Entire Agreement

These Terms and Conditions, together with the information displayed on the relevant product page, your order confirmation, our Privacy Policy and any other terms expressly incorporated into the contract, constitute the agreement between you and Fen Air International Ltd concerning the relevant purchase.
